Permesso di soggiorno renewal in 2026: the new 90-day rule
If you learned that you should renew your permesso di soggiorno 60 days before it expires, that advice is now out of date.
What changed
Legislative Decree 83/2026 amended article 5 of the Testo Unico Immigrazione (D.Lgs. 286/1998). The renewal must now be requested "almeno novanta giorni prima della scadenza": at least 90 days before expiry. The same decree raised the legal processing time for issue, renewal and conversion from 60 to 90 days, and set 30 days for a complete single work permit application.
The new rules apply from 22 May 2026 (the decree itself entered into force on 4 June 2026). You can read the current text of article 5 on normattiva.it.
What did not change
- The 60-days-after-expiry limit. Article 13 of the same law still allows expulsion when a permit has been expired for more than 60 days and no renewal has been requested. This is the absolute limit.
- The costs. A renewal costs the same as a first issue: the bollettino (€70.46 for permits up to one year, €80.46 for one to two years, €130.46 for the EU long-term permit), a €16 revenue stamp and the €30 Poste fee.
- The channel. Almost all ordinary renewals still go through the postal kit at a Sportello Amico post office.
Should you panic if you are already inside the 90 days?
No, but do not wait any longer. Filing later than 90 days before expiry is not automatically fatal, but it can complicate your case and leaves you with less cover while you wait. File as soon as you can. If your permit has already expired, or you are close to the 60-days-after-expiry limit, speak to a Patronato or an immigration lawyer before acting.
A simple routine
- Put a reminder in your calendar at about 120 days before expiry, to gather documents.
- File the postal kit by 90 days before expiry.
- Keep the ricevuta (receipt) with your passport: it proves you are legally in Italy while you wait.
- After the new card arrives, renew your health registration and, if you are registered at the Anagrafe, your dichiarazione di dimora abituale within 60 days.
